rolling through tonight. >>> summer vacation is officially over in northern virginia. students in a dozen school districts, including the city of alexandria, arlington, fairfax, loudoun, and prince william counties went back to school this morning. in vienna, parents and the kids had mixed feelings. >> how are you feeling? >> i'm just waking up. >> i'm nervous, but excited. >> i'm really excited to see all my friends. >> i'm happy to have the man of the house back. >> fairfax county is the largest school system in the area with more than 170,000 students. it has seen a spike in enrollment in the past few years while at the same time, dealing with budget cuts. >> over the last few years, we had to make cuts across the board in the classrooms, increasing class size, decreasing services in the schools. secretarial principals, the list goes on over the last two years. for this school year, we have not made any additional cuts. >> but parents will have to pay $75 if they want their child to take an advanced placement and athletes are going to be paying $100 per sport they play in school

't want to purchase. when the same lawsuit was filed in virginia, by the attorney general of virginia, ken keusch cuccinelli, that's been on your show, a federal judge in virginia appointed by a democratic president said when the government tried to dismiss the case, you know what, the attorney general of virginia is right, congress has never done this before, she have a -- they have a very strong argument to say it doesn't have this power, i'm not going to dismiss the indicate -- the case. so the passer in florida, a lawsuit, joined by 19 other states, the federal government doesn't reply with an answer, it replies with an appeal to dismiss the lawsuit so, the judge will only dismiss the lawsuit if there's no legal basis for it whatsoever. there is. martha: will it be let's move on to the next step? >> correct. the next step will then be a legal analysis of the history of the commerce clause and whether the constitution was written to give congress this kind of power. for example, suppose the congress declares that the sun causes skin cancer. that would be a reasonable statement to make.

:32 in chicago right now. >> another horrible fire to tell you about. this one at a race track in west virginia leaving 27 horses dead. this happened at the stables at charlestown races. 27 horses were saved when the owners rushed into the flames. the stables were full after a big race over the holiday weekend. no word of what caused this fire. >> all right, joran van der sloot admitting he took money from the family of natalee holloway. he said van der sloot told her family he'd reveal the location of her body and then he took the money and flew over to latin america without revealing where the body -- where her body actually was. van der sloot is accused of murdering a young peruvian woman and that's why he's in prison wearing that vest. >> meanwhile, the death toll from mudslides in guatemala has climbed to 45. a lot of people still missing. torrential rains saturated the ground and weakened the hillsides there. have been at least 15 landslides at different spots along the interamerican highway in the last two days. at least 50 people are believed to be buried in one location. >> angelina j

with an impressive track record of predicting such trends. director of the university of virginia politics and joins from us charlottesville. good to see you this morning. let's talk about what you got in your crystal ball. you are talking about essentially a gop takeover of the congress or very, very close to it. in the senate eight to nine gop seats is what larry is predicting in his crystal ball. pickup of 47 seats in the house for republicans, governor's races could swing eight of those seats to the gop side. all in all, pretty impressive election result there if all of that pans out. how did you come to these conclusions. you know, we are hearing that a lot these days. you know, forecasts are coming out. how do you get to those conclusions? >> jim, of course, we studied every race just about every day. this is our job. and we look for lots of different indicators. generic ballot, democrat versus republican. presidential popularity, state of the economy, and the strength of individual candidates, there are so many factors that go into each thing. look, jim, you have been around a long time. you

them to the polls in virginia, or massachusetts. how is the president going to convince people do this one for me again. >> he says please. please come out and vote. it's interesting because i think the white house is trying to do two different things. on the one hand, you talk to political trat gist, and they say these are hand-to-hand combat races, local races, local issues. it's not going to be a referendum on barack obama but they are turning it into a referendum on barack obama because they probably believe he is the only one who can get these people out to vote. he has to give them a reason, candy. he has to give them a message. we were out in ohio and we interviewed democratic voters. you ask what's the message of this midterm election from the democrats, and they had no idea. so what the president is going to do is try and use this tax cut issue as a message and say, we want to make the tax cuts for the middle class permanent and the republicans are going to try to hold that hostage because they don't want to raise taxes on the wealthy. that's kind of the last-ditch effort
